Was Haute Tension Plagiarism Unnoticed?

Dear Horror Freaks.

When I watched "Haute Tension", I kept thinking I had seen this movie before, the plot seemed so familiar...

It wasn't until the movie ended that I realized what it was. Except for the twist-ending, this movie was and almost perfect adaptation of Dean Koontz's book INTENSITY (even the title is similar), and yet I didn't find his name anywhere in the credits.

Can you clarify for me why there wasn't a lawsuit for plagiarism in this case?
